KADUNA, North-West, Nigeria – Four elected Kaduna lawmakers have been dragged before a Federal High Court sitting in Kaduna for alleged false information and forgery.
The four lawmakers; Shehu Balarabe, Rilwanu Amin, Bala Umar and Yusuf Ibrahim were elected on the platform of the ruling All Progressives Congress (APC).
The originating Summons with Suit Number: FHC/KD/18/2029, FHC/KD/19/2019, FHC/KD/17/2019 and FHC/KD/16/2019 filed by Counsel to the Plaintiff Hon. Mohammed Rilwanu stated that “in view of Section 31(2) (5) and (6) of the Electoral Act, 2010, (as Amended) and the facts that the information in the nomination form and Affidavit submitted by the lawmakers to INEC through APC are false'”
Speaking to the media out side the Court premises Counsel to the Plaintiff Bello Ibrahim Esq said the four Defendants’ documents bear different names and dates of birth from the one they submitted to INEC.
Acccording to him, the Defendants presented false documents accompanying/Attached to Forms CFOO1 submitted to the Electoral body either through their names, date of birth or certificates.
He gave example that Rilwanu Aminu presented documents bearing RILWANU GADAGAU while Shehu Balarabe presented documents bearing SHEHU BAKAUYE, Bala Umar also presented documents bearing BALA TAGAGI and Yusuf Ibrahim presented documents bearing YUSUF NABO.
Barrister Ibrahim averred that during the February 2019 Presidential and National Assembly Election, the defendants contested and won
Giwa/Birnin Gwari Federal Constituency, Members Kaduna House of Assembly for Giwa East, Kakangi and Giwa West Constituencies.
However Counsel to the Defendants Barrister Suleiman Shaibu said the Court has no jurisdiction to hear the case.
The presiding Judge adjourned the case to May 24, 2019 for continued hearing.
